The judgment of the Court of Appeal Abuja on Tuesday the 11th of December 2007 striking down one of the standing vestiges of colonial rule in Nigeria is very refreshing and reassuring in the sense that Nigeria may ultimately be on its path to join the league of civilized societies of the world.
 
This piece of legislation the Public Order Act now in Cap 382 Laws of the Federation of Nigeria (1990) proclaimed by the British colonial masters was to monitor and control the activities of the foremost nationalists and their huge followership whose campaign for independence and self rule gathered tremendous momentum and support during the time under review.
 
To reckon that this piece of legislation endured and found its way into our statues books after independence and subsisted even after in the face of section 40 of the 1999 Constitution of Nigeria and its equivalent provision in the previous constitutions caste tremendous doubt on the actual progress made in terms of much touted socio-political independence Nigeria acquired in 1960.
 
To be sure, the Act sought to and indeed circumscribed the fundamental rights of Nigerians to freely associate, assemble and move within the Nigeria State.
 
To further appreciate that it took such rigorous legal tussle commenced as far back as 2005 with the attendant casualties thereof clearly underscores the primitivity and backwardness notwithstanding our collective pretext (the previous day) in the celebration of the 50th anniversary of the declaration of the Universal Declaration of Human Rights.
 
We commend the judiciary, the Conference of Nigerian Political Parties (CNPP) and its lead counsel Barrister Femi Falana whose courage and conviction have finally put to rest the long speculation surrounding the propriety or otherwise of seeking and obtaining police permit before enjoying our fundamental human rights as Nigerians.
 
This judgment no doubt could not have come at a better time than now. In consequence we enjoin the police particularly the just confirmed Inspector General of Police to desist from harassing Nigerians in the enjoyment of their rights and privileges.
