The Enugu State governor's defense to a petition by Action Congress Gubernatorial Candidate, Chief Dubem Onyia, seeking for the nullification of April 14 Governorship election in the State, was struck out today by the Election Petition Tribunal sitting in Enugu.
The defense was struck out on the grounds that it did not comply with the Practice Direction of 2007 which guides proceedings before the Tribunal in Election Petition Matters. By this ruling, Chime, elected on the platform of Peoples Democratic Party (PDP) would neither be given another chance to reply to claims by Onyia that the said polls was marred with irregularities nor be allowed to present witnesses to disprove the claim but can only argue based on Law. The Tribunal had earlier dismissed a reply filed by Independent National Electoral Commission (INEC) on the grounds that it was filed out of time. Meanwhile, the Tribunal has reserved October 4, 2007 for ruling on the admissibility of election results documents presented before it by the governorship candidate of Accord Party (AP) , Chief Ugochukwu Agballah who is also contesting the election of Mr. Sullivan Chime as Governor.
