FG Inaugurates Committee on Airport Concession Print E-mail

The Nigerian Federal Government has inaugurated a coordinating committee for the MMA Concession agreement between the Federal Government and a private company, Bi-Courtney Limited. The Hon. Attorney-General of the Federation and Minister of Justice, Chief Micheal Kaase Aondoakaa (SAN), while inaugurating the committee, stated that the Yar’Adua’s administration will not deliberately resile from the fundamental terms of any agreement or contract entered into, under any guise.

According to a statement signed by the Chief Press Secretary to the HAGF, the Minister, who was represented by the Solicitor-General of the Federation and Permanent Secretary, Alhaji Abdullahi Ahmed Yola urged members of the Committee to bear in  mind the administration’s total commitment to the rule of law, and therefore urged the committee to consider the complaints of the Concessionaire and come up with appropriate recommendations.

The Attorney- General expressed the hope that at the end of deliberations by the committee, amicable and acceptable resolution of all the disputes would have been reached. It will be recalled that in May 2002 the Federal Government through the Federal Airports Authority of Nigeria (FAAN) awarded to B1- Courtney Nigeria Limited a Concession for the construction of a New Domestic Terminal at the Murtala Mohammed Airport in Lagos on a Build, Operate and Transfer (B.O.T) basis. Subsequently, an Agreement dated July 2003 was duly executed by the respective parties.

Although in the estimation of government, the operation of the agreement has continued undisturbed, the Concessionaire by its letter of June 20, 2008 to the Attorney General, notified the Federal Government of the existence of some disputes arising from the agreement referring the disputes to the Co-ordinating Committee created under the agreement by virtue of Article 22.1 thereof.

“In essence, this Committee is not an imposition by the Government on the Concessionaire, but a fall out from the mutual agreement reached by the government and the Concessionaire and, more importantly, a response to the yearning and desire of the Concessionaire”, the statement added.
